PANSAMANTALANG isinara ng Bureau of Internal Revenue (BIR) ang isang Chinese restaurant sa Makati City, gayundin ang apat na sangay nito dahil sa iba’t ibang tax violations.
Ayon sa BIR, pinadlak ng “Oplan Kandado” team ng Revenue Region No. 8A-Makati City, sa pangunguna nina Regional Investigation Division Chief, Atty. Zeus Gamaliel Mendoza at Asst. Division Chief, Atty. Jesse Alcaraz ang Shanzhen Haiwei Food Corp. (Shanzhen) noong June 29, kasama ang mga sangay nito sa Gil Puyat Avenue, Makati City; Ayala Malls Manila Bay, Parañaque City; at dalawa pa sa Bonifacio Global City, Taguig City.
“Results of the Regional Investigation Division’s surveillance conducted in February 2023 showed that the said establishment failed to register one of its branches, failed to issue registered receipts/invoices and understated its sales by more than thirty percent (30 percent), in clear violation of Section 115 of the NIRC (National Internal Revenue Code) of 1997, as amended,” sabi ng BIR sa isang statement noong Martes.
Pinapayagan ng Section 115(b) ng NIRC of 1997, as implemented through Revenue Memorandum Order No. 3-2009, ang BIR na suspendihin o ipasara ang business operations ng isang taxpayer sa loob ng hindi bababa sa limang araw dahil sa pagkabigong iparehistro, mag-isyu ng value-added tax (VAT) official receipts o sales invoices, maghain ng VAT returns, o understatement ng taxable sales/receipts ng 30 percent o higit pa ng tamang taxable sales o receipts para sa taxable quarter.
“Procedural due process was duly given to the said taxpayer by BIR Revenue Region (RR) No. 8A-Makati City, headed by Regional Director Florante Aninag, through the issuance of a 48-Hour Notice to explain the violations, and another 5-day VAT Compliance Notice to rectify the tax payment, but said taxpayer failed to comply with the said notices,” ayon sa BIR.
Ang closure order ay nilagdaan ni Deputy Commissioner Maridur Rosario at ipinatupad sa ilalim ng pangangasiwa ni Aninag.
