INATASAN ng Department of Labor and Employment (DOLE) ang mga employer sa pribadong sektor na ipalabas ang ipinagpalibang holiday pay benefits ng kanilang mga empleyado bago matapos ang taon.
Nauna rito ay nag-isyu ang DOLE ng ilang holiday pay rules kung saan binigyan nito ang mga kompanya ng opsiyon na ipagpaliban ang pagbabayad hanggang humupa ang national health emergency at magbalik sa normal ang business operations matapos ang COVID-19 pandemic.
Sa Labor Advisory No. 31 series of 2020, ipinag-utos ng DOLE ang pagbabayad ng ipinagpalibang holiday pay.
Ang kautusan ay para sa lahat ng employers sa pribadong sektor na ipinagpaliban ang pagbabayad ng holiday pay dahil sa pag-iral ng national emergency dulot ng pandemya.
Saklaw ng kautusan ang ipinagpalibang holiday pay para sa mga sumusunod na labor advisories:
Labor Advisory No. 13-A – April 2020 Holidays; Labor Advisory No. 15 – Regular Holiday on May 1, 2020; Labor Advisory No. 20 – Regular Holiday on May 25, 2020 (Eid’l Fitr); Labor Advisory No. 22 – Regular Holiday on June 12, 2020 (Independence Day); Labor Advisory No. 25 – Regular Holiday on July 31, 2020 (Eid’l Adha): Labor Advisory No. 27 – Regular Holiday on August 21, 2020 (Ninoy Aquino Day) and August 31, 2020 (National Heroes Day); Labor Advisory No. 29 — Special Non-Working Days on November 1 and 2, 2020 and Regular Holiday on November 30, 2020 (Bonifacio Day).
“Employers allowed to defer payment of the holiday pay of their employees as referred herein, are required to pay all covered employees of the deferred holiday pay equivalent to 100% of their daily wage,” nakasaad sa Labor Advisory 31.
“Covered employers shall pay the qualified employees the deferred holiday pay on or before 31 December 2020,” dagdag pa nito.
