EXTRA-JUDICIAL KILLING MAKATARUNGAN BA?

NOONG simula ng taong ito, nanawagan ang Komisyon sa Karapatang Pantao sa pamahalaang Duterte na makipagtulungan sa imbestigasyon ng Pandaigdigang Hukumang Pangkrimen ukol sa mga pagpaslang na sinasabing kaugnay ng giyera kontra sa droga.

Matatandaang sa loob lamang ng dalawang taon, (2016-2018), inihayag ng datos ng Philippine Drug Enforcement Agency (PDEA) na abot sa 4,948 na pinaghihinalaang nagbebenta o gumagamit ng illegal drugs ang napaslang. Bahagya itong bumaba matapos ang apat na taon, subalit may ilan pa ring balita ang maririnig ukol dito. Marahil, ang ilang biktima ng extra-judicial kil­lings ay totoong durugista.

Ayon sa TRIAL INTERNATI­ONAL, isang pandaigdigang samahan na luma­laban sa mga kaso ng extra-judicial killings, maituturing na extra-judicial killing ang pagpatay sa isang akusado kung hindi ito dumaan sa tamang prose­so. Ibig sabihin, titiyakin dapat ng Estado na maayos na nalitis ang kriminal at siniguro ng Estadong napangalagaan ang kaniyang karapatan sa panahon ng paglilitis.

Ngunit kung totoo silang kriminal, bakit pa natin dapat ipagtanggol ang kanilang mga karapatang pantao? Ayon na rin sa TRIAL INTERNATIONAL, ang karapatang mabuhay ang pinakauna at pundasyon ng karapatang pantao. Kung may karapatan ang isang tao sa libreng pag-aaral, wala itong kwenta kung patay na siya. Karapatan niyang maituring na tao na walang diskriminasyon.

Para sa mga taong pabor sa extra-judicial killing, simpe lang. Kung gagawa ka ng krimen, patay ka. Kung hindi ka gagawa ng krimen, wala kang dapat ikatakot.

Gaano ito katotoo?

Kapag may napatay, sasabihin ng mga kaanak na mabait ito. Sa hanay naman ng pulisya, ilang beses na nating narining na “nanlaban” ang mga biktima kaya ipinagtanggol nila ang kanilang mga sarili. Sa sobrang daming ulit na nating narinig ito ay na­ging biro na ang salitang “nanlaban”, ultimong patay na hayop sa kalye ay sasabi­hing “nanlaban” kaya pinatay. Isipin mo na lang na sa pambansang konsiyensiya ng mga Pilipino, ang napapatay sa kalye ay naihahalintulad sa hayop.

Subalit ang tanong ay “nanlaban” nga ba? Naging maingay na kritiko ng pamahalaan ang mga Obispong Katoliko, sa pangunguna ni Pablo Virgilio David, nang lumabas ang CCTV footage ng pamamaslang kay Kian de los Santos. Katulad ng dati, sinabi ng pulisya na nanlaban ang batang 17 taong gulang. Subalit sang-ayon sa CCTV ay nagmamakaawa pa nga ito.

Sa huli, ang usapin ng extra-judicial killing ay hindi lamang usapin ng pagpatay. Usapin rin ito ng hindi pagkakapantay-pantay ng ating mga mamamayan. Kalimitan, ang mga nagiging biktima ay iyong mga mahihirap. Bakit? Dahil wala silang kakayahang makapaghanap ng matinong trabaho upang buhayin ang kanilang sa­rili. Naging biktima sila ng mga pagkakataon at bunsod nito ay gumagawa sila ng mga gawaing nakapambibiktima rin ng iba.JAYZL VILLAFANIA NEBRE
