SINUSPINDE ng Bureau of Internal Revenue (BIR) ang pagpapatupad ng Revenue Regulation (RR) No. 5-2021 na nagpapataw ng 25% corporate income tax sa mga pribadong paaralan.

“To ease the burden of taxation among proprietary educational institutions, especially during this time of COVID-19 pandemic, and taking into account the pending bills in Congress… to finally clarify the income taxation of schools, the implementation of the following provisions of RR 5-2021 dated 8 April 2021 are hereby suspended pending passage of such appropriate legislation,” nakasaad sa kautusan ng BIR na may petsang Hulyo 26, 2021.

Sa pagsuspinde sa tax hike ay patuloy nang matatamasa ng mga pribadong eskwelahan ang preferential tax rate na 1%, na binabaan sa ilalim ng  Corporate Recovery and Tax Incentives for Enterprises (CREATE) mula sa dating 10%.

Sinabi ng Coordinating Council of Private Educational Associations (Cocopea) na labis na maaapektuhan ng RR No. 5-2021 ang mga magulang dahil mapipilitan ang mga eskuwelahan na magtaas ng matrikula.

Dahil dito ay pinangangambahan ding maraming eskuwelahan ang magsasara.

Ang Cocopea ang pinakamalaking organisasyon ng mga pribadong eskuwelahan na binubuo ng 2,500 schools atbeducation stakeholders.

Nagpasalamat naman ang mga senador sa pagsuspinde sa implementasyon ng RR No. 5-2021.

“Maraming salamat Secretary Dominguez and BIR Commissioner Dulay for heeding the clamor of private educators who share with government the burden of teaching our youth. This is what I call a taxation timeout. Now, the ball is on the court of Congress to permanently fix the confusion caused by the language of that law,” wika ni Senador Edgardo ‘Sonny’ Angara.

“The order suspends the collection of the tax. The permanent solution, however, will be in the form of a law purging all ambivalence in that provision of the Tax Code,” sabi naman ni Sen. Ralph Recto.

“This is one problem partially solved. Let us move forward by adopting measures that will address the crisis in the entire educational system which the pandemic has worsened,” dagdag pa niya.

Iginiit naman ni Sen. Jose Villanueva ang kahalagahan ng pag-amyenda sa batas.

“Ito po ang kailangan natin na ‘academic revenue freeze.’ Dagdag na tulong, hindi dagdag na tax ang kailangan ng mga pribadong paaralan sa panahon ng pandemya. Wala pong revenue loss dito,” anang chairman ng Senate committee on higher and technical and vocational education.
