WE have a working criminal justice system.
Ito ng iginiit ni Presidential Spokesman Harry Roque kung kaya’t hindi maaring manghimasok ang International Criminal Court (ICC) sa Filipinas.
Ayon kay Roque, isang malaking insulto sa mga abogado at mga hukom sa bansa ang nais mangyari ng mga kritiko ni Pangulong Rodrigo Duterte na magkaroon ng hurisdiksiyon ang ICC sa sinasabing extra-judicial kilings (EJK) sa panahon ng administrasyong Duterte.
“I’d like to emphasize that there is actually no crime under both domestic law or international law as EJK. In fact this is a misleading term because killing in our Constitution and in our laws is never legal so there is no such thing as extrajudicial killings. So it’s either a lawful killing or an unlawful killing,” sabi ni Roque.
Ayon kay Roque, mali ang interpretasyon ng mga kritiko ng Pangulo sa naging pahayag sa isang talumpati na ang kanyang tanging kasalanan ay EJK.
Sinabi pa ni Roque na maging ang mga pahayag ng mga kritiko ng Pangulo na magagamit na ebidensiya sa ICC at sa impeachment ay mali.
Nilinaw pa ni Roque ang nais ipakahulugan ng Pangulo sa kanyang pahayag na ito ay tanging EJK lamang ang isyu na ibinabato sa kanya at walang akusasyon sa kanya ng katiwalian kundi EJK lamang.
Sinabi ni Roque na walang pending preliminary investigation ang ICC laban kay Pangulong Duterte taliwas sa nais palabasin ng mga kritiko nito.
“I’d like to reiterate there is no pending preliminary investigation in the ICC as of yet. What is pending only is a communication addressed to the prosecutor. The prosecutor at this stage is only examining if she should in fact proceed to a preliminary investigation” wika ni Roque.
“This (Duterte’s EJK remark) cannot be taken as an admission because the President was not admitting to murder,” dagdag pa ni Roque.
“I refuse to concede and admit as a Philippine lawyer, as an officer of the Court, that our Courts are unable or unwilling to exercise jurisdiction. Those who have complaints against the President, better file their complaints against him here in the Philippines,” dagdag pa ni Roque. EVELYN QUIROZ
