IMPEACHMENT VS LEONEN IHAHAIN SA 2022 -ATTY. GADON

HINDI pa rin nawawalan ng pag-asa ang kontrobersiyal na si Atty. Larry Gadon sa pagkakabasura ng isinusulong na impeachment case sa Kongreso laban kay Supreme Court Associate Justice Marvic Leonen.

“We can try another impeachment case next year in a more receptive House leadership. An ordinary citizen like Ed Cordevilla has no power to secure original copies nor access to original documents from the SC , BIR and UP for that matter,” saad ni Atty. Gadon.

Ikinalungkot ni Gadon ang pagkakadismis sa naturang kaso subalit tiwala itong sa susunod na taon ay positibo itong katigan ng Kamara ang naudlot na impeachment case.

Ipinagtataka ni Gadon na noong sa kaso ni dating SC Chief Justice Ma. Lourdes Sereno, pinayagan ng Kamara kahit xerox copy lamang ang kanilang isinumiteng mga dokumento para umusad ang impeachment case.

“The House committee has all the inherent and plenary powers to issue subpoena duces tecum for the purpose of ascertaining the truth,” wika pa ni Atty. Gadon.

“Impeachment is unlike ordinary cases in regular courts where the complainant has the burden to produce original documents, unless they are in the possession of the adverse party as an exception,” paliwanag pa nito.

“An impeachment case is a sui generis and does not adhere strictly to the rules of court as the primary objective is to know the truth and for this principle the House can use its plenary and inherent powers to issue subpoenas like what it did to Sereno case,” dagdag pa nito.

Kasunod nito, umaasa pa rin si Gadon na mapapansin ng liderato ng Kamara sa susunod na taon ang nasabing reklamo bunsod ng malinaw ang kanilang mga ebidensiya na magpapatunay na nararapat patalsikin si Leonen sa pamamagitan ng impeachment. BENEDICT ABAYGAR, JR.
