NAGPALABAS ang Securities and Exchange Commission (SEC) ng cease and desist orders para sa anim na online lending companies na nag-o-operate nang walang kaukulang permit.
Sa Commission en banc order na inisyu noong Oktubre 24, inatasan ng SEC ang mga operator at owner ng Batis Loan, Happy Credit, Easy Cash, Wahana Credit & Loan Corp., PesoMaMa, at Light Kredit na agad itigil ang kanilang operasyon.
“Certifications issued by the Commission’s Company Registration and Monitoring Department (CRMD) showed that Batis Loan, Happy Credit, Easy Cash, Wahana Credit & Loan Corp., PesoMaMa, and Light Kredit were not registered as corporations or partnerships,” ayon sa SEC.
“The CRMD further attested that the online lending operators were not issued the necessary certificates of authority to operate as lending companies nor had pending applications for such,” dagdag pa ng commission.
Sa ilalim ng Lending Company Regulation Act of 2007, ang lahat ng lending companies ay nararapat na itayo bilang isang corporation, at walang lending company ang papayagang magpautang hanggang hindi pinapayagan ng SEC na mag-operate.
Ang mga lalabag sa batas ay mahaharap sa parusang pagkabilanggo ng anim na buwan hanggang 10 taon o/at pagmumulta ng P10,000 hanggang P50,000.
“The cease and desist order extends to the agents, representatives and promoters, owners of hosting sites, and all persons acting for and on behalf of the online lending operators.”
Inatasan din ng commission ang mga lending operator na tanggalin ang kanilang promotional presentations at offerings sa internet, kabilang ang lending applications na kanilang ino-operate.
“Considering that these Online Lending Operators are not incorporated entities or have no Certificate of Authority to Operate as Lending Companies or Financing Companies, the lending activities and transaction are illegal and must be immediately stopped by this Commission,” nakasaad pa sa kautusan.
