ANG IMPLLEMENTASYON NG REPUBLIC ACT NO. 11229

Mga kapasada, nagsimula nitong Pebrero ang implementasyon ng Republic Act No. 11229 o Ang Child Safety in Motor Vehicles Act, ayon sa Land Transportation Office (LTO). Ang naturang batas, ayon sa  paliwanag ng LTO, aynagtatadhana among others na ang mga batang may edad na 12 taono pababa ay kailangang ligtas sa anumang ‘di mabuting pangyayari samantalang lulan ng sasakyan tulad ng pagkakaroon ng angkop na car seats saman-talang naglalakbay sakay ng isang priadong sasakyan.

Gayunman, sinabi ng LTO na hindi pa naman sinisimulan ang panghuhuli at pabibigay ng kaukulang ticket sa mga lalabag sa batas na ito sa loob ng tatlo hangang anim na buwan mula nang ito ay pinasimulang ipatupad. “Enforcement is not only about apprehension – it also covers information dissem-ination as well as warnings,” payag ni Roberto Valera, LTO deputy director for Law Enforcement, sa isang virtual briefing na ginanap noong nakaraang Enero 29.

Bilang karagdagan, ang CRS ay kailangang tumutugon sa standard set na itinalaga ng Department of Trade and Industry (DTI), tulad ng tinukoy sa DTI Department Administrative Order  No. 20-03 kabuntot ng ipinatutupad na kahingian ng International Standard. Gayundin, isasapubliko ng DTI ang talaan ng mga brand na tumutugon sa  mga hinihingi ng RA 11229, na naipagkaloob  na ng Philippine Standard na may tatak o import clearance certifi-cate.

MULTA AT PARUSA SA MOTORISTANG LALABAG SA RA 11229

Ayon sa paliwanag ng LTO, ang sino mang motorista na mahuhuling lumabag sa RA 11229 ay papatawan ng multang P1,000 sa unang paglabag, P2,000 sa  ikalawang paglabag at P3,000 para sa paggamit ng ‘di tamang CRS. Nagbabala ang LTO na ang pinakamabigat na parusang ipapataw sa sino mang drayber na mahuling  lumabag sa batas na ito ay papatawan ng pinakamabigat na parusang multang P5,000 para sa ikalong paglabag at suspensiyon ng driver’s license.

Sa kabilang dako, ang mga manufacturer, distributor, importer, retailer at mga nagtitinda ng CRS ay papatawan naman ng multang P50,000 hanggang P100,000 sa production, distribution, importation at pagbebenta ng substandard o expired CRS, gayundin ang anumang tampering o forgery ng certification ng stickers.

Ayon naman kay Atty. Daphne Marcelo, policy associate for road safety and public-interest law firm, ang mandatory use ng CRS sa ilalim ng RA 11229 ay para sa private motor vehicles kaya ang binabanggit ay yaong mga sasakyang privately owned o yaong mga sasakyang rerentahan lamang (under lease).

PRIVATE MOTORIST INSPECTION CENTER ‘DI NA MANDATORY

Umani ng taos-pusong pasasalamat at papuri ang Pangulong Rodrigo Duterte matapos ipahayag kamakailanng Palasyo ng Malakanyang na hindi na mandatory ang Private Motorist Vehicle Inspection Center (PMVIC).

Magugunitang sa unang quarter ng 2020 ay hiniling ng LCSP, sa pangunguna ni Inton, sa Department of Transportation (DOTr) at sa LTO) na huwag na munang ipatupad o ituloy ang programang ito dahil hindi pa na papanahon sa kadahilanan ng kaakibat na maraming problema at kasaluyang dumaranas ang mga motorista ng malakking problema sa COVID-19 pandemic.

Kasabay naman nito, nagsampa rin ng demanda ang ilang grupo ng Private Emmission Testeng Center (PETC) sa pangunguna ng Clear Air Move-ment of the Philippines, Inc. (CAMPI) dahil sa pagpapatigil sa nasabing programa. Ayon sa PETC, kahit walang matibay na dahilan ay sinuspinde ang kanilang mga accreditation para hindi sila makapag- operate sa layunin nito na bigyang daan ang PMVIC.

PANGULONG DUTERTE ‘DI SANG-AYON SA PAGPAPATUPAD NG CHILD CAR  SEAT LAW

Inihayag kamakailan ni Senator Bong Go na hindi sang-ayon si Pangulong  Duterte sa implementasyon ng Child Car Seat Law.   Ang pahayag ay ginawa ni Go sa Laging  Handa briefing kamakailan dahil hindi ito naging katanggap-tanggap sa motoring public bunga ng kalituhan sa mga patakaran matapos na inihayag sa publiko  ng LTO ang mandatory compliance sa naturang batas simula noong ikalawa ng Pebrero ng taong kasalukuyan.

Ayon kay Sen. Go, hindi pa napapanahon na ipatupad ang RA No. 11229 o ang Child Safety in Motor Vehicles sa gitna ng pagkalito ng maraming motorista sa tadhanain nito bukod sa kailangan ang kahandaan sa pagpapatupad kaya ipinasiya ng transportation authority na ipagpaliban ang full enforcement ng naturang batas.

Sa ilalim ng nasabing batas, ang mga pribadong sasakyan ay kailangang gumamit ng child restraint system para sa mga batang may edad na 12 at pababa na  may taas na 150 sentimetro o 4’11 upang  matiyak ang kanilang kaligtasan sa pagbibiyahe at paramaiwasan  ang traffic-related deaths and injuries.

Samantala, sinabi naman ni LTO Chief Edgar Galvante na walang dapat ikabahala ang mga motorista na baka sila hulihin o tiketan at pagmultahin sapagkat ang kanilang target ay ang pagpapakalat ng impormasyon sa awareness tungkol sa batas.

Sa kabilang dako, inihayag naman ni Transportation Assistant Secretary Golddes Libiran na, “LTO may implement new guidelines sa loob ng anim na buwan o higit pa hanggang sa matapos ang pananalasa ng pandemya.
