WALANG nilabag na probisyon sa Saligang Batas ang gobyerno sa nilagdaang Memorandum of Understanding (MOU) sa kooperasyon ng oil and gas development sa pamahalaang China.
Ito ang kinumpirma ni Supreme Court Acting Chief Justice Antonio Carpio sa ginanap na Forum on the West Philippine Sea.
“What was signed was not a joint exploration. Joint exploration and exploitation is what China proposed to us in their version. They sent us a version and it’s called “joint exploration and exploitation” joint exploration and exploitation violates the Constitution because the Constitution says the state shall have full control and supervision in the exploration and exploitation,” ani Carpio
Ipinaliwanag nito na may nakapaloob na clause sa nilagdaang MOU kung saan malinaw ang magiging papel ng China sa gagawing oil and gas development.
“We are saying to China, yes let’s cooperate but through our service contractors. Why is that important? Because our service contractors have been awarded a concession by the Philippine government, by Department of Energy and in that concession, its very clear sovereignty, sovereign rights belongs to the Philippines,” dagdag pa ni Carpio.
Naniniwala pa si Carpio na sa ngayon ay ang pakikipag-alyansa pa rin ang pinakamabuting paraan lalo’t walang sapat na armas at puwersa ang Filipinas para ipagtanggol ang ating karapatan.
Nanawagan naman sa gobyerno ang isang Catholic Bishops’ Conference of the Philippines (CBCP) official na ihayag sa publiko ang mga naging kasunduan nito sa Chinese government.
Ayon kay Father Jerome Secillano, karapatan ng sambayanang Filipino na malaman kung ano ang mga pakinabang ng Filipinas sa naging pagdalaw ni Chinese President Xi Jinping sa bansa kamakailan. ANA ROSARIO H, AIMEE A
