Sa payahag ni SBMA Chairman and Administrator Wilma T. Eisma, ang nasabing veggies ay nakalagay sa limang- 40-footer container vans na idineklarang frozen assorted vegetables at naka-consigned sa importer na Saturnus Corp. na nakabase sa Metro Manila.
Nabatid na ang kontrabando ay pinigil ng mga awtoridad noong Oktubre 13 dahil sa non-compliance sa inaprobahang sanitary at phytosanitary import clearance (SPS-IC) base sa temperature requirement bilang non-importable fresh vegetables.
“We found out that the shipment contained chilled fresh vegetables that are considered illegal for importation into the country. These included various fresh produce such as water bamboo, mushrooms, broccoli, and other vegetables,” pahayag ni Atty. Eisma.
Bukod sa walang sanitary import clearance ay nadiskubre rin na undeclared agricultural products tulad ng sweet oats.
Hindi nakalusot ang alibi ng importer kina Atty. Eisma, BOC District Collector Marites Martin at Agriculture Assistant Secretary for Economic Intelligence Federico Laciste Jr., matapos ang masusing inspection ng contraband sa New Container Terminal.
Nag-isyu na ang opisina ni Martin ng warrants of seizure at detention para sa nasabing shipment kung saan ang importer na Saturnus Corp. ay may permit to import frozen vegetables.
Nabatid din kay Martin na ang temperature ng frozen commodities ay kailangang nasa 18 degrees Celsius subalit ang refrigerated containers ng Saturnus shipment ay -1 degrees Celsius kaya ang inisyung Importation clearance ay hindi applicable sa instant importation.
Ayon pa sa ulat, ang nasabing shipment ay paglabag sa agency’s Administrative Order No. 18, series of 2000, and Sec. 19 of DA Department Circular 4, series of 2016, in relation to Section 1113 (f) of Republic Act No. 10863 otherwise known as the Customs Modernization and Tariff Act (CMTA).
