HINILING ng Pivot International Inc. and Power Service (PSI) Inc. Joint Venture, o PSI Joint Venture, sa mga opisyal ng Commission on Elections (Comelec) na ideklarang “failure of bidding” ang isinagawang pagsubasta sa refurnished vote counting machines (VCMs) na gagamitin sa halalang 2022.

Ginawa ito ng PSI Joint Venture matapos tanggalin o idiskuwalipika ng Special Bids and Awards Committee (SBAC) ng Comelec ang naturang kumpanya sa naganap na bidding noong Marso 5, gayung ang PSI Joint Venture ang idineklara ng Technical Working Group (TWG) ng SBAC na siyang nakapagpasa ng lowest calculated bid (LCB).

Bukod sa pinakamababang bid kumpara sa joint venture ng Smartmatic USA Corporation at SMMT – TIM 2016, Inc., pasado rin ang PSI Joint Venture sa hiningi ng Comelec na mga rekisito para sa automated election system (AES) sa halalang isasagawa sa Mayo, 2022.

Ang kahilingan ng PSI Joint Venture sa Comelec – SBAC ay kasama sa inihain nitong reklamong administratibo laban sa sa end user, chairman at mga kasapi ng SBAC at TWG ng Comelec dahil sa ‘krimeng’ nag-ugat sa kaduda-duda umanong ikalawang bidding ng VCMs.

Ang VCMs ay instrumento ng Comelec sa aktuwal na pagboto ng mga botante sa halalang isasagawa sa Mayo, 2022.

Naniniwala ang PSI Joint Venture na mahalagang pagsabayin ang kahilingang failure of bidding at pagsasampa ng “administrative complaint for grave misconduct, serious dishonesty and conduct prejudicial to the best interest of service” laban kina Jeannie Flororita (end user), Allen Francis Abaya (SBAC chairman), John Rex Laudiangco (SBAC vice – chairman), mga kasapi ng SBAC na sina Jovencio Balinguit, Divina Blas Perez at Abigail Claire Carbero Llacuna dahil sa kanilang paglabag umano sa Seksiyon 7 ng Republic Act 8436 na inamyendahan ng R.A. 9369 (o ang batas patungkol sa AES na nagsimula noong Mayo 11, 1998 hanggang sa mga sumunod na halalan).

Bagamat kasama ang mga miyembro ng TWG  sa kaso, hindi na isinama ang kanilang mga pangalan.

Idiniin ng PSI Joint Venture sa reklamo nito na gusto nitong matigil ang katiwalian at korapsyon sa bidding system ng Comelec, kaya naghain ang nasabing kumpanya ng reklamo laban sa ilang opisyal ng Comelec na nakatoka sa bidding.

Batay sa rekord ng SBAC-AES at TWG ng Comelec, nanalo ang PSI Joint Venture sa bidding dahil ito ang naghain ng LCB kumpara sa joint venture.

Ngunit, nagulat ang PSI Joint Venture nang igawad ng Comelec ilang araw na ang nakalipas ang kontrata sa joint venture ng Smartmatic USA Corporation at SMMT – TIM 2106, Inc., samantalang batay sa rekord mismo ng Comelec SBAC-AES ay higit na mataas ang inalok nitong presyo kumpara sa PSI Joint Venture.

Nangangahulugang pinaboran na naman ng Comelec ang Smartmatic US Corporation.

Mula noong 2010 ay iginagawad na ng Comelec sa Smartmatic US Corporation ang mga ginagamit ng ahensiya sa halalan.

Mula eleksyong 2010 ay palagi nang sumusulpot ang malaganap na reklamo ng dayaan sa eleksyon, kabilang na ang 2016.

Matatandaang maging si Pangulong Rodrigo Duterte ay nagalit sa Smartmatic dahil sa dayaan sa halalan.

Gusto ni Duterte na mawala na ang Smartmatic sa eleksyon ng bansa.

Ayon sa PSI Voint Venture, hawak nito ang mga ebidensiyang nagpapakita at nagpapatunay na mayroong ginawang “collusion” sina Flororita, Abaya, Laudiangco, Balinguit, Blas Perez at Carbero Llacuna na “directly involved in the procurement planning and bidding of the vote counting machines (VCMs) Refurbishment with Consumables – 2nd bidding SBAC Ref. No. 012020VCRM”.

Nakarating sa mga kinatawan ng PSI Joint Venture noong Marso 29 ng taong kasalukuyan ang ebidensiya ng “collusion” ng mga opisyal ng Comelec.

Idiniin din ng PSI Joint Venture na maliban sa R.A. 9369, nilabag din nila maging ang Seksiyon 3 ng R.A. 3019.

Ayon sa kumpanya, lahat ng elemento ng korapsyon ay makikita sa naganap sa ginawang bidding ng end user, chairman, vice chairman at mga kasapi ng SBAC at mga miyembro ng TWG.

“[T]hey have acted with manifest partiality evident bad faith or gross inexcusable in the discharge of the duties as end user/implementing units and members of the SBAC,” pahayag ng nagrereklamo.

Sila ay “guilty of giving a private party with unwarranted benefits, advantage, or preference,” patuloy ng PSI Joint Venture.

Mahalaga sa PSI Joint Venture ang bidding dahil sa pamamagitan nito magsisimula ang patas na labanan ng mga pribadong kumpanyang gustong makuha ang proyektong VCM ng Comelec.

Buo ang tiwala at taas-noo ang PSI Joint Venture na magiging maayos, malinis at walang dayaang magaganap sa bidding ng VCM, kaya lumahok sila rito.

Isinaad ng PSI Joint Venture sa dokumento ng reklamong administratibo nito na noong Marso 5 ng taong kasalukuyan ay lumahok sa bidding ang PSI Joint Venture kung saan nanalo ang naturang kumpanya dahil ang inahain nitong presyo ay siyang pinakamababa.

Noong Marso 5 rin idineklara ng Special Bids and Awards Committee – Automated Elections System (SBAC-AES) ang “bidder which submitted the Lowest Calculated Bid (LCB).”

Ibig sabihin, nagwagi ang PSI Joint Venture sa Comelec bidding ng VCM.

Dahil sa panalo, otomatikong isinailalim ang PSI Joint Venture sa tinatawag na “post-qualification evaluation”, o testing ng secure digital cards (SD Cards) alinsunod sa Revised Implementing Rules and Regulations (RIRR) ng Republic Act 9184, o ang Government Procurement Reform Act.

Naganap ang testing ng Main SD Cards at ng Write Once Read Many (WORM) SD Cards ng PSI Joint Venture noong Marso 12.

Dalawa sa limang set ng Main at WORM SD Cards ang kinuha ng SBAC-AES, samantalang ang tatlong set ay ipinadala sa Department of Science and Techonlogy (DOST) upang isailalim sa pag-aaral at pagsusuri.

Tinukoy ng PSI Joint Venture na ang dalawang set ng Main at WORM SD Cards nito na hawak ng SBAC-AES ay isinalang sa “formatting” sa computer ng SBAC-AES Technical Working Group (TWG).

“The formatting of the WORM cards, however, was done despite a prior and clear manifestation made by Mr. Alfred S. Cayton, a representative of the [PSI] Joint Venture… that the WORM SD Cards do not need further formatting because such act will be considered with tampering with the WORM SD Cards,” paliwanag ng PSI Joint Venture sa reklamo nito sa Comelec.

Idinagdag pa nito na siguradong apektado ang “operability” ng WORM SD Card.

Nang matapos ang testing, nadiskubre ng SBAC-AES na 15GB na lang ang kapasidad ng WORM SD card ng PSI Joint Venture, sa halip na 16GB na siyang orihinal.

Sa hiwalay na pag-aaral ng DOST ay nakita nitong walang depekto ang SD Cards ng PSI Joint Venture.

Ang rekisito ng Comelec ay 16GB ang SD Card na alam at malinaw sa PSI Joint Venture bago ito sumalang sa bidding ng VCM ng Comelec.

Umaasa ang PSI Joint Venture na maparurusahan ang matataas na opisyal ng Comelec na sina Flororita, Abaya, Laudiangco, Balinguit, Blas Perez at Carbero Llacuna at mga kasapi ng TWG batay sa nakasaad sa R.A. 8436 na inamiyendahan ng R.A. 9369 at R.A. 3019.
