DALAWANG Philippine Army senior officials at limang iba pa na itinuturo sa likod ng pagpatay sa isang Davao City-based model-business woman ang isasalang na sa general court martial proceeding ngayong Linggo.

Ito ay matapos na aprubahan ni Army Commanding General Lt. Gen. Romeo S. Brawner, Jr. ang isasampang administrative charges laban sa mga akusado na inirekomendang litisin sa ilalim ng General Court Martial.

Nabatid na pangungunahan ni Court President, MGen. Jose Eriel M. Niembra, na kasalukuyang 10th Infantry Division Commander at naging kasapi rin ng Presidential Security Group ang General Court Martial.

Una rito ay winakasan ng Philippine Army ang ginawang pagrebisa sa administrative liability nina BGen Jesus Durante III, Col Michael Licyayo at ng limang enlisted personnel kaugnay sa kaso ng pagpatay kay Yvonette Chua Plaza noong nakalipas na Disyembre 29, 2022 sa labas lamang kanyang tinutuluyang bahay sa Davao City.

Agad na ipinag-utos na ilipat sina Durante at Licyayo at iditine sa Eastern Mindanao Command (EASTMINCOM) headquarters, Camp Panacan, Davao City kung saan gaganapin ang administrative military proceeding na inaasahang masisimulang ngayong araw na ito.

Ang mga nabangit na military officials at enlisted personnel ay inihabla kaugnay sa paglabag sa Article of War 96, (which refers to conduct unbecoming of an officer and a gentleman), at paglabag sa Article of War 97 (which refers to all disorders and neglects to the prejudice of good order and military discipline and all conduct of a nature to bring discredit upon the military service.)

Ayon sa batas….”Art. 96. Conduct Unbecoming an Officer and a Gentleman. — Any officer, member of the Nurse Corps, cadet, flying cadet, or probationary second lieutenant, who is convicted of conduct unbecoming an officer and a gentleman shall be dismissed from the service.”

Article 97, which states that “all disorders and neglects to the prejudice of good order and military discipline,” and all conduct that brings discredit to the military service, “shall be taken cognizance of by a… court-martial…and punished at the discretion of the court.”

Samantala, kinilala naman ang limang military men na isinasangkot sa pagpatay kay Plaza na sina Staff Sergeants Gilbert Plaza at Delfin Sialsa Jr.; Corporal Adrian Cachero; at Privates First Class Rolly Cabal at ang AWOL na si Romart Longakit na haharap sa paglilitis sa Army 10th Infantry Division.

Ang general court-martial ang siyang pinakamataas na antas ng trial court na lilitis sa hanay ng militar na sangkot sa alleged serious crimes.

“It will look into the administrative aspect of the case and will be conducted parallel to the trial by a civilian court,” paliwanag ni Col Xerxes Trinidad, ang spokesperson ng hukbong Katihan ng Pilipinas.

Una ng inihayag ni Brawner na binigyan na ng kopya ng reklamo hinggil sa violation of Article of War 96 (conduct unbecoming of an officer and a gentleman) at 97 (conduct prejudicial to good order and military discipline) sina Durante at Licyayo, na una ng sinibak sa kanilang mga pwesto bilang commander at deputy commander ng 1001st Infantry Brigade.

Habang kasong murder, theft and obstruction of justice naman ang isinampa sa civilian court noong pang buwan ng Enero laban sa mga suspek sa Plaza slay case na sinasabing pinaslang ng dalawang motorcycle riding assassin.VERLIN RUIZ
