ALBAY – IPINAAARESTO ng Regional Trial Court National Capital Region-Branch 3 si Daraga, Albay Mayor Carlwyn Baldo kaugnay sa kasong pagpatay kay dating Ako Bicol Partylist Rep. Rodel Batocabe noong Disyembre, 2018 sa isang gift giving activity sa mga senior citizen sa nasabing bayan.
Ito ay matapos magpalabas at mag-isyu ng resolution ang First Division ng Supreme Court na nilagdaan ni Maria Teresa B. Sibulo, Division Clerk of Court na may petsang Pebrero 28, 2024 kung saan pinaboran nito ang Motion for Extension of 30 days at petition for review on certiorari ni Baldo.
Subalit ibinasura naman ng korte ang Petition for Review on Certiorari of the Decision and Resolution noong February 28, 2023 at April 24, 2023 ng Court of Appeals.
“Court further resolved to DENY the petition for failure of petitioner to sufficiently show that the Court of Appeals committed any reversible error in the challenged decision and resolution as to warrant the exercise of this Court’s discretionary appellate jurisdiction” saad sa decision.
“The Court furthermore resolved to:
- NOTE the petitioner’s Manifestation stating that he submitted a scanned copy of the Second Verified Declaration dated June 19, 2023, which was executed due to the failure of the petitioner to retain a copy of the Verified Declaration dated June 19, 2023 duly filed with the petition for review on certiorari, through e-mail; and
- DROP the Court of Appeals as respondent in this case, pursuant to Sec. 4, Rule 45, 2019 Amendments to the 1997 Rules of Civil Procedure (A.M. No. 19-10-20-SC).
Samantala, nagpalabas na ng pahayag si Justine Batocabe, anak ng pinaslang sa inilabas na aresto sa naturang alkalde.
“To date this is the third time I, together with our family’s legal team, will send him to jail. While we know the road is still long, we thank the RTC Judge and Supreme Court in finding that the bail was erroneously issued. We pray that the PNP immediately apprehend the murderer as soon as possible. Should he continue in his flight from justice, I hope the DILG could step in and levy the appropriate administrative penalties. I hope and pray that this is the last and permanent time that he go to jail; and that ultimately Justice may be served” ayon sa batang Batocabe.
