(Lusot na sa Kamara) REGULASYON SA COMMERCIAL PARKING

APRUBADO na sa ikatlo at huling pagbasa sa Mababang Kapulungan ng Kongreso ang panukalang batas na naglalayong isasailim sa kaukulang government regulations ang ‘pay parking operations’.

Sa botong 253 pabor at wala namang naghain ng ‘no vote’ at nag-abstain, inaprubahan ng Lower House ang ‘Parking Operations and Fees Regulation Act’ na iniakda ni Deputy Speaker for Trade and Industry at Valenzuela City Rep. Wes Gatchalian.

Pagbibigay-diin ni Gatchalian, ang naturang panukala ay nagtatakda ng panuntunan na magbibigay proteksiyon sa mga consumer mula sa hindi makatuwirang pagbabayad ng parking fee at sa kabilang banda naman ay magtitiyak sa parking operators na mababawi at magkakaroon sila ng kita mula sa kanilang investments.

“On top of regulating the rates that may be charged, the bill also sets standards to maintain security and order in these parking establishments. I am glad that the bill is one step closer to becoming a law despite some misgivings of the owners of retail and commercial establishments and independent parking operators,” pahayag pa ni Gatchalian.

Kabilang sa mga saklaw ng panukalang batas ang lahat ng uri ng parking facilities ng ‘covered establishments’ para sa iba’t ibang uri ng sasakyan, kabilang ang bicycles, motorcycles, at automobiles.

Hinggil naman sa parking rates, nais ni Gatchalian na ang naka-confine o out-patients sa health service establishments na gagamit ng parking facilities ng huli ay hindi na singilin habang ang non-patients ay pagbabayarin ng P20 per hour.

“Customers of accommodation establishments, including hotels, motels, hostels, inns, and resorts, shall not be charged parking fees provided there is proof of transaction with the establishment. Non-customers will be charged P20 per hour,” dagdag pa ng Valenzuela City lawmaker.

“Meanwhile, parking fees in food service establishments shall be waived for the first two hours for customers, after which P20 shall be charged per hour. Non-customers will also be charged P20 per hour. Customers of retail establishments – including malls, shops, supermarkets, and retails stores – shall be given free parking for the first two hours, provided there is proof of transaction for an amount not less than P1,000.00. Non-customers shall be charged P20 per hour but not to exceed P100 per day,” aniya.

Nakasaad din sa panukala na ang parking rate sa commercial establishments ay P40 para sa first four hours at P20 per succeeding hour at P140 per day lamang ang maximum habang sa ‘open parking enterprises’ ay P30 para sa first three hours at P20 per succeeding hour at sa multi-level parking enterprises ay P40 sa first three hours at P20 per succeeding hour.

“The rates charged by open parking enterprises and multi-level parking enterprises shall not exceed P100.00 per day. Street parking shall be charged P50 per hour while the maximum overnight parking fee shall be P150 per vehicle. Lost parking tickets may also be charged a maximum of P150 per vehicle,” ani Gatchalian.

Hinggil naman sa pagkakaroon ng minimum standards para sa seguridad ng lahat ng parking establishments, dapat, aniya, itong magkaroon ng CCTV cameras, security guards, sapat na bilang ng entrance at exit booths upang maiwasan ang traffic congestion, at iba pa.

“So, on top of providing minimum standards, the proposed law will also hold establishment owners accountable for loss of property or damage to a customer’s motor vehicle while the said vehicle is inside their parking spaces by prohibiting them from invoking a waiver of liability.” ROMER R. BUTUYAN
