NASA P131.4-billion na kita ng pamahalaan ang inaasahang mawawala sa 2022 kapag inaprubahan ng mga mambabatas ang suspensiyon ng excise tax sa mga produktong petrolyo, ayon sa Department of Finance (DOF).

May P24.7-billion ang hindi makokolekta ng Bureau of Customs (BOC) bilang baseline excise revenues, habang nasa P106.7-billion ang mawawalang koleksiyon sa incremental excise revenues sa ilalim ng Tax Reform for Acceleration and Inclusion (TRAIN) law o Republic Act 10963.

Sa kanyang memorandum kay Finance Secretary Carlos Dominguez III na may petsang October 20, sinabi ni Finance Undersecretary for Revenue Operations Group Antonette Tionko na  ang naturang mga numero ay base sa tinatayang kabuuang excise collection mula sa mga  produktong petroloyo sa susunod na taon.

“Any suspension of the imposition of excise taxes should be appropriately studied as the revenue to be foregone is substantial and may affect the government’s budget for COVID-19 recovery measures,” ayon kay Tionko.

Nauna nang iminungkahi ni Energy Secretary Alfonso Cusi ang pagsuspinde sa excise taxes sa fuel products sa gitna ng serye ng oil price hike, na resulta ng mga kaganapan sa pandaigdigang merkado.

Aniya, “the government can tap the provision of the TRAIN law for this purpose, particularly the suspension of excise tax if average Dubai crude oil prices based on Mean of Platts Singapore (MOPS) rose for three months prior to the scheduled excise tax hike implementation hits USD80 (around PHP4,000) per barrel or higher.”

Tinukoy rin niya ang pangangailangan para sa emergency powers tulad ng ipinagkaloob sa Pangulo sa ilalim ng Bayanihan to Heal as One Act para mapagaan ang pagtaas sa presyo ng langis.

Gayunman, kalaunan ay sinabi niya na hindi maaaring gamitin ng pamahalaan ang parehong measures at ang tanging paraan para suspendihin ang pagpapatupad ng excise tax sa fuel products ay sa pamamagitan ng legislation.

Kinumpirma ni Tionko na hindi maaaring gamitin ng pamahalaan ang safety net provision sa ilalim ng  TRAIN law dahil nag-lapse na ang covered period.

Sa ilalim ng TRAIN law, ang nasabing  provision ay maaari lamang gamitin mula Jan. 1, 2018 hanggang 2020.
