INATASAN ni Pangulong Rodrigo Duterte ang lahat ng ahensiya ng gobyerno na bawasan ang “overregulation” upang mas maging madali ang pagnenegosyo sa bansa.

Ito ang nilalaman ng Administrative Order No. 23, na may titulong “Elimi­nating Overregulation to Promote Efficiency of Government Processes,” na nilagdaan ng Pangulong Duterte noong Pebrero 21, 2020.

“All national government agencies covered by Section 3 RA (Republic Act) No. 9485, as amended, are directed to hasten the reform of their processes in order to eliminate overregulation,” sabi pa sa AO.

Nakasaad sa Section 3 ng RA No. 9485, na inamyendahan ng RA No. 11032,  o mas kilalang  “Ease of Doing Business and Efficient Government Service Delivery Act of 2018,” na saklaw ang lahat ng tanggapan at ahensiya ng gobyerno maging ang mga local government units, government-owned or controlled corporations at iba pang government instrumentalities na nasa Filipinas at maging  ang mga nasa abroad na nagbibigay ng serbisyo sa mga business at nonbusiness related transactions na tinutukoy sa nabanggit na kautusan.

Ayon pa sa AO, ang lahat ng mga kinauukulang ahensiya ay pananatilihin lamang ang mga steps, procedures at requirements na kinakaila­ngan alinsunod sa kanilang legal mandates at policy objectives.

“All processes in excess thereof, including those which are redundant or burdensome to the public, shall be deemed manifestations of overregulation and shall be removed accordingly,” sabi pa sa AO.

“The imposition of tedious or time-consuming regulations on socially beneficial activities, as to render such activity impossible or extremely difficult to undertake, shall be especially targeted for reform,” ayon pa sa kautusan.

Ipinag-utos ng Pangulong Duterte sa Anti-Red Tape Authority (ARTA) sa pakikipagkoordinasyon sa mga Anti-Red Tape Unit ng bawat ahensiyang saklaw na masusing magmonitor at tiyakin na sinusunod ang direktibang matigil ang overregulation.

“All the covered national government agencies have to provide the ARTA, copy furnished the Office of the President, a compliance report on how their respective Citizen’s Charters conform with the requirements of RA No. 9485, as amended, within 60 working days from the effectivity of the Order,” sabi pa sa AO.

Samantala, ang mga saklaw ng Republic Act No. 11234 “Energy Virtual One-Stop Shop Act” (EVOSS), ang ARTA ay naatasang mag-review at mag-evaluate ng mga compliance report, at bumuo ng kanilng  findings at recommendations sa EVOSS Steering Committee.

Ang mga opisyal ng gobyerno na mabibigong sumunod sa naturang AO ay nanganganib na sampahan ng kaukulang administrative cases. EVELYN QUIROZ
